SPYSEE Terms of Service

ACCEPTANCE OF TERMS

  1. This Terms of Service, as amended from time to time, governs your use of SPYSEE services offered by Ohma Inc. on its website. By using SPYSEE services, you agree to these terms and conditions, and all modifications that may be published from time to time by us.
  2. You are subject to any posted guidelines or rules applicable to SPYSEE, which may be posted and modified from time to time. All such guidelines or rules are hereby incorporated by reference into these terms of service.

REGISTRATION

Certain portions of SPYSEE require users to register to obtain certain SPYSEE services. Registration is initially available to anyone over 13 years of age and is limited to one registration per user. In registration for these services, you agree to (1) provide true, accurate, current, and complete information about yourself as requested by the SPYSEE registration form and (2) maintain and update the registration information to keep it true, accurate, current, and complete.

PRIVACY

  1. Your use of SPYSEE services is also subject to Ohma Inc.’s Privacy Policy (the “Privacy Policy”). By using the SPYSEE services, you signify your irrevocable acceptance of the Privacy Policy. You can review the most current version of the Privacy Policy at any time.
  2. The consent of SPYSEE consists of information publicly available on the websites. All the information has been identified, indexed and compiled through an automated process without any advance review by human beings. Given the enormous volume of website information added, deleted, and changed on a frequent basis, SPYSEE cannot and does not pre-screen anything made available through its indices. We will endeavor to deal with the problems that may arise in respect of the privacy issues promptly upon your request.

DEREGISTRATION

  1. Upon request from you on the prescribed form, we will cancel your registration.
  2. You agree that your registration will be canceled in the event of the following:
    1. Any difficulty in provision of SPYSEE services due to an error in the registration information or an interruption of the internet access environment;
    2. Any violation of these Terms of Service or any supplemental terms for the SPYSEE services; or
    3. Any other event that deems inappropriate to let you remain registered.

RESPONSIBILITIES

  1. You may use SPYSEE services for lawful purposes only. You may not use SPYSEE in any manner that (1) violates or infringes in any way the rights of others, (2) is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, or otherwise objectionable, (3) encourages conduct that would constitute a criminal or other offenses, or (4) otherwise violates any applicable law, ordinance, procedures or policies, any right of any third party, or any rights of privacy or publicity.
  2. You also may not undertake any conduct that, in our judgment, restricts or inhibits any other user from using or enjoying SPYSEE services.
  3. You agree not to send automated queries of any sort to SPYSEE’s system without express permission in advance from us.

INTELECTUAL PROPERTIES

  1. Ohma Inc. is the sole owner of the software, SPYSEE services, including without limitation, all applicable copyrights, patents, trademarks, and trade secrets, and other intellectual property rights thereto.
  2. You acknowledge that all of your postings will be available publicly.

DISCLAIMER

  1. SPYSEE service, and all materials, information, products, and services included in SPYSEE services are provided “as is,” with no warranties whatsoever, whether express or implied, including warranties of suitability. Ohma Inc. disclaims any warranties regarding the security, reliability, accuracy, timeliness, or performance of SPYSEE services.
  2. SPYSEE contents consist of information that has been identified, indexed and compiled through and automated process with no advance review by human beings. As such, Ohma Inc. assumes no responsibility regarding infringement of privacy in respect of the consent posted on SPYSEE services.
  3. SPYSEE assumes no responsibility regarding the accuracy of the information from the Web and use of such information is at your own risk. By furnishing information, SPYSEE does not grant any licenses to any copyrights, patents or any other intellectual property rights. SPYSEE is not responsible for the legality or accuracy of the websites linked with SPYSEE pages.
  4. You acknowledge and agree that postings and any and all liabilities arising from postings are the sole responsibility of the user who posted the content, and not Ohma Inc. Ohma Inc. does not control the postings and does not guarantee the accuracy, integrity, or quality of any postings.
  5. In no event shall Ohma Inc. be liable for any indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with your use of the site or with the delay or inability to use it.

GOVERNING LAW

This Terms of Service is governed by and construed in accordance with the laws of Japan without regard to any conflict of law provisions. You agree the Tokyo District Court shall have exclusive jurisdiction as the court of first instance in respect of any dispute relating to the terms, interpretation or performance of this Terms of Service and any supplemental terms.
